Mr. Atwell handles contract litigation, probate litigation, real estate litigation, commercial lending and transactional matters in both Texas and Colorado. Mr. Atwell's past and current clients include Fortune 500 corporations, small businesses and affluent individuals. Mr. Atwell believes in cost-effective litigation and the ethical pursuit of every client's objectives. Mr. Atwell's experience at a well-regarded commercial litigation boutique and smaller litigation offices helped form his approach.

For five years, he worked in Dallas for Carrington Coleman Sloman & Blumenthal, LLP. In 1996, Mr. Atwell moved to Steamboat Springs, Colorado, eventually becoming a partner in the AV-rated firm, Oliphant Hammond O'Hara and Atwell, LLC, in Steamboat Springs. Mr. Atwell handles a variety of complex litigation and real estate matters and has extensive experience working with financial institutions. He handles construction litigation, probate litigation, estate administration, debtor/creditor issues and commercial disputes for clients. Mr. Atwell's transactional practice includes the formation of real estate investment entities, commercial loan documentation, and a variety of real estate and corporate transactions. Recent Engagements

  • Represented Colorado based regional bank and Texas based credit union in numerous workouts of distressed commercial real estate loans. Loans ranging in size from $300,000 to over $7,800,000.
  • Represented regional bank in suit against insurance broker and insurance company over wrongful denial of flood insurance claim under dubious circumstances. Secured significant settlements against both defendants in amounts sufficient to defray bank's losses from the wrongfully denied claim based on a historic flood event.
  • Represented developer in claims against property and casualty insurer arising out of refusal to defend multimillion dollar claims based on defective lake construction. Case settled with insurer paying all of client's defense costs, eventual costs of settlement with plaintiffs, and costs to secure compliance with the policy.
  • Represented Texas credit union in foreclosure of two multi-million dollar commercial loans including successful negotiations with tenants to activate assignments of rents pre-foreclosure. Defeated borrower's requests for temporary restraining order and temporary injunction allowing foreclosures to proceed in a timely way. Counseled lender on resale of foreclosed properties resulting in sale within 90 days to third party.
  • Represented lenders in dozens of commercial loan originations over last several years. Negotiated with borrower's counsel to both parties' satisfaction so that deals would close in a timely way.
  • Represented severely injured taxi cab passenger in personal injury case against cab company and cab driver. Case settled on confidential terms.
  • Represented estate in claims against real estate brokers for breach of fiduciary duty involving sale and subsequent flips of valuable hill country ranch property at much higher and undisclosed prices. Case settled on confidential terms.
  • Represented man in claims against former girlfriend who had wrongfully obtained title to multi-million dollar residential property based on normally un-enforceable oral promises. Case settled after favorable judgment in client's favor.
  • Represented numerous personal representatives in probating testate and intestate estates in Colorado and Texas. Estates range in size from de minimus to over five million dollars.
